On June 4, 1970, the Pacific Gas and Electric Company (PG&E) and the Sacramento Municipal Utility District (SMUD) entered into a “Power Sale, Exchange and Integration Contract” and an “Amendment to 1966 Revised Sale and Interchange Contract.” Petitioner, Northern California Power Agency (NCPA) seeks review of two orders of the Federal Power Commission (Commission) which denied petitioner’s request for a hearing on the antitrust implications of the PG&E-SMUD contracts which were subsequently filed as rate schedules with the Commission by PG&E.
