Plaintiff appeals as of right from the trial court’s denial of declaratory relief in favor of plaintiff and grant of declaratory judgment in favor of defendant. We reverse.
Plaintiff, a metropolitan district covering Macomb, Wayne, Oakland, Washtenaw, and Livingston Counties, incorporated pursuant to MCL 119.51 et seq.; MSA 5.2148(1) et seq., has developed a system of parks known as "metroparks”.
