CLARK, J.

This is an action of forcible detainer, -commenced on the 19th day of June, 1890, in a justice’s court in Logan county, in the First district, where judgment was rendered against the defendant, from which he appealed to the district court. In the district •court of said county by agreement of parties, a jury was waived and the case was tried by the court, and a judgment in words and figures following, was rendered:

“It is therefore considered, ordered and adjudged by 'the court, that the plaintiff recover from said defendant the possession of…
