A noticed motion herein to dismiss was passed to the merits and is now denied by reason of our determination on the merits.

This complicated affair grows out of the claimed rights under several conflicting chattel mortgages and a conditional bill of sale.

In April, 1923, Hart, the mortgagor, and also the vendee in the conditional sale contract involved herein, who had been operating a dairy ranch near Kalama, Cowlitz county, also began operations on a place known in the record as the Marion Smith place, about two miles north of Kelso.
