Employers Reinsurance Corporation (“ERC”) brings suit against Mid-Continent Casualty Company (“MCCC”) to determine whether the parties’ reinsurance agreement requires it to reimburse MCCC for certain fees and expenses which MCCC incurred in declaratory judgment actions with its insureds.
