On October 13, 2012, Plaintiff Matthew Jenkins ("Jenkins") was arrested by members *181of the New York City Police Department ("NYPD") for selling crack-cocaine to an undercover officer. Def. Statement of Undisputed Facts Pursuant to Local Rule 56.1, ECF No. 67 ("Def. 56.1"), ¶ 4.
