In this action, plaintiff Gladys Green, a California resident seeks compensatory and punitive damages for an alleged wrongful refusal to pay benefits claimed under a health insurance policy. The policy was issued by defendant Mutual of Omaha Insurance Company (“Mutual”), a Nebraska corporation. Plaintiff joined twenty un known defendants as “Does I through XX” as permitted under Cal.Civ.Proc.Code § 474. 1
