Defendant, Scott Perry, was convicted, after a jury trial, of possession of heroin, a controlled substance. He was sentenced to imprisonment for five years.1 He appeals alleging the trial court erred in denying his motion for a mistrial and request to quash the venire panel and in submitting a verdict directing instruction that was not supported by the evidence. We reverse and remand.
