Jenks, J.:

The action is for negligence. On October 30, 1902, a signal company was at work upon a contract with the defendants. The plaintiffs’ intestate, a qualified electrical engineer, was the superintendent of construction for the signal company. The work hid been doing for two months on the elevated fabric of the defendants near the Harlem Eiver bridge. . This fabric bore four tracks on which daily 600 regular trains passed "to and from the city of New York.
