Appeal from a judgment of the County Court of Schenectady County (Hoye, J.), rendered June 18, 2004, upon a verdict convicting defendant of the crimes of assault in the second degree and endangering the welfare of a child.

While eating dinner with their two-year-old child, defendant and his paramour (hereinafter the victim) became embroiled in a heated argument.
