TUTTLE, District Judge.

This is a petition for a writ of habeas corpus, alleging that petitioner has been illegally and without warrant oí law drafted into the military service of the United States under the conscription statute.

The petition alleges that petitioner is an alien, 25 years of age and a citizen of Austria-Hungary, who has not declared his intention to become a citizen of the United States; that on June 5, 1917, he duly registered under the provisions of the act of Congress of May 18, 1917, known as the Conscription Act; that when he presented himself, for registration he informed…
