The plaintiff brought this action in the district court of Salt Lake county upon four alleged causes of action. The first two alleged causes of action arise out of the same transaction, and the third and fourth alleged causes of action also arise out of the same transaction; but the first and second alleged causes of action arise out of a transaction separate and distinct from the third and fourth causes of action. Trial was had by the court sitting without a jury. At the conclusion of plaintiff’s evidence, the defendants and each of them moved for a judgment of nonsuit. The trial court…
