William Smith commenced an action against an insured of the defendant, General Casualty Company of Wisconsin (hereinafter General Casualty), in the Circuit Court of La Salle County, Illinois. As required by the liability policy of the insured, General Casualty undertook the defense of the claim. General Casualty was represented by counsel as was Smith, who was represented by Donald S. Frey of Evanston; Illinois.
