Reversing.

This action was begun by the appellee, whom we will refer to as the plaintiff, against the Beaver Creek Consolidated Coal Company and appellant, Elkhorn Coal Corporation, to quiet his title to the oil and gas under about 1,500 acres of land, the surface of which he owns,. In this litigation he was entirely successful. From the judgment adjudging him to be the owner of this oil and gas, the defendant, Elkhorn Coal Corporation, has appealed.
