This was an action of assumpsit brought by appellee against appellant in - the Circuit Court of Jackson county. The pleadings culminated in one special count and the common money counts, a special plea with issue joined thereon, and general issue pleaded to the common counts. The case was tried by the court without a jury and resulted in a finding and judgment in favor of the plaintiff for $1,121.35 and costs of suit. The defendant appealed.
