This is a suit brought by the appellee against the appellant to recover damages for personal injuries to appellee, alleged to have been caused by the negligence of the appellant.
was the employment of appellant as a switchman in its railroad yard in the city of Houston. In the performance of the duties of his employment he went upon a car in a train which was being switched in said yard and attempted to set the brake upon said car. While thus engaged the brakestaff broke, and appellee was thrown to the ground, from the car and was seriously and painfully injured.…
