Appellee filed this suit for damages on account of personal injuries alleged to have been, received by him on or about February 13, 1915, alleging, in substance, that be was driving a horse attached to a delivery wagon at the southwestern corner of the public square in Cleburne, that one of defendant’s interurban cars came from the southeastern corner of said square, and that appellee’s horse became frightened at the car, and finally kicked him on one of bis legs, resulting in the alleged injuries and consequent damage.
