Gumport, in his capacity as trustee of the bankruptcy estate of Transcon Lines (Trans-con), appeals from the district court’s summary judgment in favor of Sterling Press (Sterling). The determinative issue in this case is whether certain antiforfeiture provisions of the Bankruptcy Code, 11 U.S.C. §§ 363(i) and 541(c)(1)(B), prohibit the application of section 2 of the Negotiated Rates Act of 1993 (Rates Act), Pub.L.
