Gaynor, J.:
The relator was tried and convicted hy a city magistrate in the borough of Brooklyn, and sentenced to a term of imprisonment of six months in the Kings county penitentiary. She seeks to be released by writs of habeas corpus and certiorari.
The complaint against her was that she was “ a common prostitute and night walker, and that she was on the night of the 20th of January, 1903, in the borough of Brooklyn, City of Hew Tork,- and county of Kings, loitering in Hudson avenue near De Kalb avenue, that being a public thoroughfare and public place, soliciting and importuning men passing…
