after making the above statement, delivered the following opinion of the court:

The assignments of error present the questions for decision which will be passed upon in their order, as stated below:

Does the consent of a board of supervisors, under subsection 8 of section 1294-b (1 Pollard’s Code, 1904), to a change of location of a public road by a railroad company shield the latter from liability for such damages, if any, as such change may cause to the owner or occupant of any lands?
