Hall, Judge.

1. Count 3 alleged that the defendant insurer insured the property of Tel-Star Mills, Inc. (hereinafter called the insured). A copy of the insurance contract was attached to the petition with endorsements making a union pension fund and Joel Hurt Factors, Inc., loss payees. After the policy was issued the plaintiff became a secured creditor of the insured under- a security instrument in which the insured expressly agreed to keep its property insured against fire and casualty loss.
