Plaintiff West 97th-West 98th Streets Block Association now moves for a preliminary injunction enjoining defendants from any further rehabilitation or occupancy of 305 West 97th Street (the Building). Defendant Volunteers of America of Greater New York (VOA) now cross-moves to dismiss the complaint pursuant to CPLR 3211 (a) (5) (Statute of Limitations) or, alternatively, pursuant to CPLR 3211 (a) (7) (failure to state a cause of action).
