The defendant was convicted' of the offense of keeping open a tippling-house on the Sabbath day, and excepts to the order overruling his motion for new trial. As plaintiff in error, he assigns error on certain instructions contained in the charge of the court, and on failure of the court to charge certain principles which he contended were material on the trial. Error is also assigned on the ruling of the court in excluding §149 of the city code of Augusta, with reference to dealers in intoxicating liquors; and on the action of the court in interrupting the defendant in his statement, and the…
