Reversing.

Plaintiff and appellee, Harrison Carter, filed this suit in the Letcher circuit court against defendant and appellant, the Consolidation Coal Company, its mine foreman, its electrician, and one of its brakemen on a coal car, seeking to recover $25,000.00 damages for the loss of one of his legs which he claimed was caused from injuries sustained by him through the negligence of de*572fendants. Before the trial the suit was dismissed or abandoned as to all of the defendants except the'corporation and its electrician, Dan Bellamy.
