—In an *551action to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Richmond County (Rosenberg, J.), dated June 12, 2000, which granted the plaintiffs motion, in effect, for leave to enter a judgment against him upon his failure to answer the complaint.
Ordered that the order is reversed, on the law and the facts, with costs, and the motion is denied.
