The plaintiff brought a declaratory judgment action seeking a declaration with regard to the terms of a certain promissory note. The plaintiff alleged in the complaint that on January 20, 1976 it purchased from the defendant a tract of land located in Screven County, Georgia and in conjunction therewith executed a promissory note and a deed to secure debt in favor of the defendant.
