Appeal from an order and judgment of the Supreme Court (Rose, J.), entered March 12, 1993 in Broome County, which dismissed plaintiff’s complaint.
This action arises out of injuries allegedly sustained by plaintiff on April 9, 1991 while he was visiting defendant’s bar *889and restaurant. On that date, a fight apparently broke out between some of the tavern’s patrons, during the course of which plaintiff allegedly was struck by one of the participants in the altercation.
