Herein we will refer to the defendant in error, E. G. King, as the proponent, and to the plaintiff in error, G. M. Brummett, as the contestant, that being the manner they were designated below.

Jennie Smith, herein referred to as testatrix, departed this life at Sapulpa, in Creek county, Oklahoma, on or about the 2nd day of August 1948, survived by the contestant, a son by a former marriage, sometimes referred to in the testimony as Will Brummett. At the time of her death she was of an advanced age, given by most of the witnesses as at least 80 years.
