This action is prosecuted in the name of the State, on the relation of Madison civil township of Montgomery county. It is alleged in the complaint of the relator that Thomas Wilson was duly elected and qualified as the trustee of Madison township, and that he, as principal, and the other defendants as sureties, executed the bond sued on to secure the faithful performance by him of the duties of that office.
