Appeal from an order of the Supreme Court (Hughes, J.), entered December 9, 1999 in Albany County, which granted plaintiff’s motion for partial summary judgment on the issue of liability.
On September 30, 1996, as plaintiff was travelling westbound on Interstate Route 90 in Albany County, a tractor-trailer turnover forced plaintiff to bring her vehicle to a stop in traffic. Shortly thereafter, plaintiff was rear-ended by a vehicle owned by defendant Team Fleet Financing Corporation and operated by defendant William P. Hunt.
