This suit is by the widow and child of deceased for the alleged willful, reckless, and negligent killing of deceased by Russell, a member of the copartnership of Weeks & Russell.

The material averments of the declaration are that J. D. Weeks and Knox Russell are partners engaged in the retail drug business in the municipality of Ackerman; that deceased, Gan I>.
