Appeal from a judgment of the superior court for Walla Walla county, Mills, J., entered June 12, 1913, upon the verdict of a jury rendered in favor of the defendants by direction of the court, in an action for personal injuries sustained at a railroad crossing.

Action for personal injuries.

At the close of all the evidence offered at the trial of the case in the court below, the court directed a verdict in favor of the defendants. The plaintiff has appealed from the judgment entered thereon.

It appears that, on the 22d day of October, 1912, while the plaintiff was driving across the tracks of the defendant railroad company, he was run down by a train. The horse *350which he was driving was killed, or so badly injured that it was necessary to kill him; the wagon was destroyed; and the plaintiff’s leg was broken, and he was otherwise injured.
