The plaintiffs in error, hereinafter referred to as the defendants, were convicted in the county court of Alfalfa county, on a charge of transporting intoxicating liquors, and each sentenced to pay ■a fine of $50 and serve 30 days in the county jail.
The evidence shows that Diar Goff, sheriff of Alfalfa county, saw the defendants and Donald Brokovski drive away in a car, and he went out on the road and watched until they returned, and, as they were coming down the road approaching the sheriff, he turned out in the middle of the ro¡ad and stopped the car in which the defendants were riding,…
