This matter is before the Court on Defendants’ motion for summary judgment (DE 33).

A. Background

Plaintiff Frank McAllister sued the Town of Burns Harbor, its police department and its chief of police, Jerry L. Price, alleging state law claims for negligence and negligent infliction of emotional distress, and violations of 42 U.S.C. § 1983.
