HARPER, Judge.
Appellant was prosecuted and convicted as the keeper of a disorderly house in Wichita Falls, Texas, and his punishment assessed at twenty days confinement in jail and a fine of $200.
It may be said that the wife of appellant was the owner of the property, under the evidence in this case, and that she owned it prior to her marriage to appellant. He and his said wife lived on the premises and the question is, could he he convicted of keeping a disorderly house, when the proof showed that his wife owned the property?
