THIS CAUSE is before the court upon defendant Robert D. Dube’s (“Dube”) motion to dismiss (DE # 22) plaintiff Excess Risk Underwriters, Inc.’s (“ERU”) first amended complaint as filed against him. ERU has filed an eleven count complaint against Dube and Lafayette Life Insurance Co.
