1. Introduction
THIS CAUSE is before the Court upon Defendants’ Motion to Dismiss (DE # 48, filed July 15, 2003) Plaintiffs’ Consolidated Amended Complaint (DE # 42, filed May 9, 2003). Plaintiffs filed their Opposition to the Motion to Dismiss (DE # 59) on July 15, 2003, and Defendants filed a Reply (DE # 64) on September 15, 2003.
