I concur, in part, because I agree that the defendants’ argument, to the extent based on permit requirements for the transportation and processing of oil and gas,1 should be rejected, and *817with the following statement in the opinion of the Court:

The permits defendant received were not issued by the Supervisor of Wells, but rather were acquired from the dnr and Michigan Public Service Commission pursuant to other regulatory authority.
