This action was brought by L. L. Logan-bill against E. E. Zook to enforce the specific performance of a contract to sell real estate. The relief sought was denied, and plaintiff has appealed.

The contract, dated September 10,1928, by its terms obligated the defendant to sell, and the plaintiff to buy, the E. % of section 17, township 8 south, range 8 east, Gila & Salt River Base and Meridian, located in Pinal county, for the sum of $16,000, payable as follows: $1,000 in cash; $5,000 on January 1, 1930; $5,000 on January 1, 1931; and $5,000 on January 1, 1932.
