GALLAGHER, Chief Justice.

Appellant, Otto Reinert, sued appellee, W. P. Lawson, for damages for the alleged ■breach of a contract by the terms of which appellant agreed to sell to appellee, and he agreed to purchase from appellant, a certain gin plant in the city of Hamilton. Appellant copied said contract in his petition. It contained a provision for the payment of a forfeit or liquidated damages by either party who refused to consummate the same.
