GURFEIN, District Judge:

This is an appeal from an order of the District Court for the Northern District of New York, Judge Foley, entered on February 12, 1973, denying plaintiffs’ motion for a preliminary injunction after a hearing and dismissing the complaint.

Plaintiffs are the Albany Welfare Rights Organization (AWRO) and individual members and welfare recipients. AWRO is a local chapter of the Upstate New York affiliate of the National Welfare Rights Organization, which has some 150,000 members in approximately 850 local organizations throughout all fifty states.
