This is an appeal from a judgment in the district court of Houston County, transferred to this court from the Court of Civil Appeals for the First Supreme Judicial District, at Galveston, by an order of the Supreme Court.

Appellant Suda filed suit against appellee Vaughan in trespass to try title to 94.2 acres of land out of the James Patton Survey in Houston County. Appellee Vaughan, by his First Amended Original Answer and Original Cross-Action, filed plea of general denial and not guilty, ’ also pleaded facts which he alleged placed equitable title in him,…
