Appeal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered March 9, 2006, upon a verdict convicting defendant of the crime of murder in the second degree.

Defendant and the victim lived together in a long-term relationship that began to deteriorate early in 2005, with mutual allegations of infidelity and incidents of physical violence and verbal abuse. These incidents culminated on August 12, 2005, when defendant killed the victim by repeatedly striking her in the head with a hammer.
