This is an interlocutory appeal on certified questions from rulings of the United States District Court for the Southern District of New York (Abrams, /.). interpreting the Digital Millennium Copyright Act of 1998 (“DMCA”). The DMCA establishes a safe harbor in § 512(c), which gives qualifying Internet service providers protection from liability for copyright infringement when their users upload infringing material on the service provider’s site and the service provider is unaware of the infringement. 17 U.S.C. § 512(c).
