Scott Michael Stebbins (“Stebbins”) brings this appeal pursuant to 28 U.S.C. § 1291 (1986). Specifically, appellant alleges that the district court committed reversible error when it instructed the jury regarding the non-taxability of any award of damages under Virginia law. Appellant argues that this instruction may have caused the jury to return a lower verdict. Appellant also alleges that the award of damages was inadequate as a matter of law and that the district court erred when it failed to grant a new trial on those grounds.
