Plaintiff J. Gregory Milne (“Milne”) brought this action against the Clerk of the Town of Barnstable (the “Town Clerk”)1 to require her to swear him into two elected positions. The people of Barnstable elected Milne to serve as a member of Town Council and as a member of the Barnstable Charter Commission (“Charter Commission”) on November 6, 2007.
