On November 19th, 2007, the plaintiff, J. Gregory Milne (“Milne”), filed a verified complaint against Linda Hutchenreider (“Hutchenrei-der”), in her official capacity as Town Clerk for the Town of Barnstable (“Town"). Milne alleged that although he was elected to the Office of Town Councillor and Charter Commission Member on November 26, 2007, Hutchenreider refused to swear him in to both elective offices.
