Joseph E. Thomas sued Ruth A. Martin (now Hogan) and Betty J. Brannock for *541personal injuries allegedly received on January 24, 1959, when he was struck by an automobile, owned by Brannock and driven by Miss Martin, while crossing Bellinger Boulevard, near the Naval Air Station, Norfolk, Virginia. Betty J. Brannock was subsequently dismissed as a defendant and the case was tried before a jury, resulting in a verdict in favor of Thomas against Ruth A. Martin Hogan in the sum of $40,000.00.
