LEDERLE, District Judge.

1. The petitioner herein brought this action pursuant to Section 338(a) of the Nationality Act of 1940, 8 U.S.C.A. § 738(a), seeking cancellation of certificate of citizenship #3,972,976 issued to Herbert Mickley, respondent herein, by this Court on December 9, 1935. Service was had upon the respondent in accordance with the terms of the Act and he appeared by counsel. An order for a pre-trial hearing in accordance with Rule 16, Rules of Civil Procedure, 28 U.S.C.A. following section 723c, was entered and served on April 8, 1-942, and the pre-trial hearing was held on…
