This was an action of assumpsit brought in the circuit court of Cook county by plaintiff in error to recover as the beneficiary named in a death benefit certificate issued by the defendant in error to Wilhelm Jordan, brother of plaintiff in error. The first trial in the circuit court resulted in a judgment in favor of plaintiff. Upon appeal by defendant to the Appellate Court for the First District that judgment was reversed and the cause remanded. (Supreme Lodge Order of Mutual Protection v. Zerulla, 99 Ill. App. 630.)
